These conditions regulate the entrance for visitors to BAGRPARK. By purchasing a ticket or entering the BAGRPARK area, you agree and confirm your acquaintance with the operating rules and rules for the use of attractions.

DESCRIPTION OF THE BAGRPARK AREA

The entire BAGRPARK complex is located in the Autodrom Most, as building, it is fenced and divided into four sections. In BAGRPARK there is a grass and asphalt structure. An information and camera system is installed in the entire BAGRPARK.

Equipment:

In the BAGRPARK complex there is a brick building with a bathroom, around which there is a parking lot for customers.

The following containers are located in the BAGRPARK complex:

living containers: 1x container - refreshments, 1x container - cash register, 2x two containers - women's and men's locker rooms with sanitary facilities (toilet, washbasin, lockers), 1x container - operating room - kitchen (fridge, microwave oven, electric kettle, equipment can employees use it during lunch or snacks), sanitary facilities, toilets and changing rooms are cleaned daily.

Sanitary facilities, toilets and changing rooms are cleaned daily. The person in charge of cleaning has a reserved room in the brick building of the bathroom, here washing and cleaning products are stored. There is also a place for a sink.

Hygiene products are available to employees. Drinking water is from the water supply system, hot - cold.

The first aid kit is located at the cash register, at the staff and in the staff's operating room.

In the first part of the BAGRPARK complex there are construction machines with the possibility of testing.

Construction machines: Mini excavator 2t, wheel dumper with turns 1.5t, skid steer loader 3t, vibrating road roller 1.6t, mini excavator 3.5t.

In the second part of the BAGRPARK complex there is a playground where these attractions are.

Attraction:

Trampoline, jumping excavator, sandpit, two wooden climbing frames and slides. In the third part of the BAGRPARK complex there is an off-road track and an asphalt track for buggies

Motor vehicles: Buggyny.

The fourth part of the BAGRPARK complex serves as a traffic playground. Here you can rent electric carts, bicycles, scooters and pushers. There is also a children’s playground with wooden climbing frames and a swing. Electric vehicles: Truck, excavator, dumper.

CONDITIONS

Visitor:

all people who have valid tickets and all accompanying children who are entitled to free entry to the park

anyone who is a member of a private or corporate group and has purchased a group ticket

anyone who participates in any of the experiences or events of BAGRPARK and all authorized visitors who accompany them

any paying or qualified non-paying carer or helper accompanying a disabled and / or vulnerable child or adult

CONDITIONS

Operator:

1. BAGRPARK reserves the right to change or amend these Terms without prior notice. No such change or addition will retroactively affect any existing (prepaid / reserved) ticket holders unless it is in their favor.

2. By entering the premises of Autodrome Most, as, all visitors must follow the rules of Autodrome Most, they may only use the road for access to the BAGRPARK car park. He must park his vehicle, motorcycle or bicycle in the reserved parking lot for BAGRPARK. Vehicles may not be parked in a car park other than the one reserved for BAGRPARK. By entering the BAGRPARK it is fully subject to these General Terms and Conditions and by purchasing a ticket (ticket) or by entering the park (including the access lanes and car parks) it is considered that the visitors have accepted these Conditions. Use of the car park is only possible at your own risk, it is not a guarded car park.

4. The maximum capacity of the park for entry is 2,000 people. If the capacity of the park is reached, the operator may prevent the access of other visitors for a certain period of time. Claims against the operator arising from this restriction are not admissible.

5. By entering the BAGRPARK complex, the visitor gives permission to make audio and video recordings of his person, which can be taken during his presence in the park for promotional purposes of BAGRPARK, without any right to compensation and without time or space restrictions.

6. BAGRPARK staff shall, at their discretion, exercise the right to either take out any visitor (s) or, if necessary, have that visitor (s) removed by the police who is in breach of the law or, at the worker's discretion, is in conflict with the entry and visit conditions. no refund of the ticket price (s) will be offered or provided. 7. BAGRPARK reserves the right to refuse entry to any person determined by the park manager to be in breach of these conditions. If the visitor is denied entry to BAGRPARK and has purchased a ticket, the ticket price will be refunded in full. If the park attendant determines that the visitor violated these conditions before entering, the entrance to the park will be prevented immediately and the full amount will be refunded.

8. All employees of the park regularly undergo statutory training. The staff is also trained in the field of occupational health and safety.

9. Smoking is prohibited in the entire BAGRPARK!

10. Cleaning of the whole BAGRPARK is provided provided continuously during the day, including emptying the baskets. Waste bins are located throughout the complex. Containers for sorted waste are located in a reserved and accessible place. The final cleaning of the entire BAGRPARK will be ensured after the end of the park operation. Sanitary facilities are marked in the area by an information system, located at the beginning of BAGRPARK, in the middle and at the end of BARKUPARK. This equipment is also cleaned regularly. At the end of the BAGRPARK's operating hours, the children's sandpit will be properly covered with a tarpaulin, and in the morning, when the tarpaulin is uncovered, the operator will inspect the sandpit. The tarpaulin will then be folded and stored in the designated place.

11. Waste collection and sludge export is contractually secured.

12. All machines will be continuously disinfected after each visitor. There will be disinfectants to use at each attraction site.

VISITOR HEALTH AND SAFETY

1. Please note that there may be situations where BAGRPARK will need to close due to circumstances such as natural disasters, extreme weather conditions such as strong storms or strong winds that could make it dangerous to open the park or run some of the attractions.

2. In the event that the park cannot be opened due to adverse weather conditions or other circumstances beyond the organizer's control, BAGRPARK will of course offer the visitors concerned an alternative ticket reservation.

3. Alternatively, it may be necessary to close one or more attractions in the park due to circumstances such as natural disasters, extreme weather conditions such as strong storms or strong storms that could make it dangerous for visitors to enjoy the attractions.

4. For the avoidance of doubt, if one or more attractions are not available for any reason, but BAGRPARK is open to visitors and most of its attractions are still open, so no refund or new entry will be provided.

5. Most attractions in BAGRPARK are are construction machines such as excavators, dumpers, rollers and manipulators, as it is also the case in most amusement parks and amusement park visitors, Accidental injury if they do not pay all due care and attention to safety precautions, or will ignore safety or warning signs and instructions from park staff.

6. BAGRPARK, sro cannot accept any responsibility or liability for any injury suffered by any visitor who has not complied with the "Conditions of Health and Safety for Visitors", as set out below.

7. In the event of an accident, the staff of BAGRPARK will provide a first aid kit and, in agreement with the injured party and his entourage, will consider calling an ambulance. Each accident must be reported to the cashier, the accident is recorded in the form. The establishment is equipped with first aid kits, which are regularly inspected and replenished. The staff is properly trained for these situations.

8. Entry to the parks is subject to strict adherence to all safety or warning signs and instructions of the park staff and "Health and safety conditions for visitors BAGRPARK as below.

9. All visitors, adults and children, must follow and obey the instructions a of the BAGRPARK operator safety advice.

10. Visitors are fully responsible for ensuring and protecting their own health safety, which must pay all due care and attention. They must observe all safety warning signs and operating instructions for the BAGRPARK and observe the "Conditions of health and safety for visitors".

11. Visitors who are either parents or guardians, or supervising or responsible adults accompanying a child or children under the age of 15, shall have full responsibility for the safety and health of the child or children in their care and shall accompany and supervise them throughout their visit. park and ensure that they also pay due care and attention and follow all safety warning signs and BAGRPARK operator's instructions.

12. Visitors supervising or responsible adult accompanying a child or children under the age of 15, or disabled and vulnerable persons of any age, shall be fully responsible for the safety and health of the child or children. Persons in their care must accompany and supervise them throughout their visit to the park and ensure that they also pay due care and attention and follow all safety warning signs and instructions of the park staff.

13. Most attractions are subject to minimum or maximum height restrictions, and some attractions also have age restrictions that must be followed. These restrictions affect whether or not the child is allowed to ride, or must be accompanied, or can drive and drive on his own. 14. A visitor (whether a child or an adult) waiting in line for an attraction must not attempt to enter any premises or tracks without the consent and permission of the park staff.

15. The visitor (whether child or adult) must not climb, jump or climb, or help another (whether child or adult) to climb, jump or climb on any safety fences, barriers, pens and tire barriers around the premises, tracks, playgrounds or attractions.

16. The visitor (whether a child or an adult) may not sit, stand or lean over security fences or enclosures around the premises or tracks of any of the attractions.

17. Visitors may drive, but may not operate or drive any attractions unless they are medically fit, have epilepsy, occasional seizures or have any other medical condition that normally prohibits them from driving on road vehicles and may affect the safe operation of any attraction in BAGRPARK.

18. In the event of a mechanical failure or accidental collision at one of the attractions, or getting stuck, or the driver simply forgets or is unsure how to operate the controls, the driver and other passengers must remain seated in the machine and switched on ( é) seat belt (s) until they are approached by an operator who will advise when it is safe to leave / empty the machine. Of course, in the (though unlikely) case that the machine starts to burn or emits smoke with a hint of fire, visitors should leave the machine in a responsible, orderly manner, as quickly and safely as possible.

19. Alcohol, drugs or medicines… Any visitor who, in the opinion of the operator or park manager, is not qualified to drive attractions and drive safely because he is or appears to be intoxicated with alcohol or under the influence of drugs or adversely affected by medicines, BAGRPARK shall exercise the right to either: refuse entry to the visitor; or, if necessary, have the visitor expelled from the park by the police; or at least refuse to allow the visitor to ride, operate or manage some or all of the attractions ... In these circumstances and for the avoidance of doubt, no compensation for the visitor's entry / ticket will be offered or provided.

Rules and behavior of visitors

1. Climbing the outer nets of all attractions and the outer parts of the diving excavator is prohibited. Admission to the attraction inflatable excavator is allowed only to children under 14 years, their number is limited to a maximum of 20 children.

2. Please follow the rules located when entering the trampoline. The capacity of children is 20.

3. Electric cars in the traffic playground area drives on tips that must be purchased at the box office. Their operation is managed exclusively by a person designated for this purpose. A maximum of 1 child can ride in a toy car. For children who need to be accompanied by an adult while driving, only the track for electronic cars on the traffic playground is reserved. 4. Small pushers, pushchairs, scooters and bicycles are intended exclusively for children and can only be used on the traffic playground.

5. Motor buggies are intended for children from 6 years of age, they run on tokens, which must be purchased at the BAGRPARK box office. Without helmet, visitors will not be allowed on the track. While driving, do not tick into tires and other buggies. No one is allowed to run into or near the track while driving. All visitors who wish to ride buggies will follow the rules and conditions located at the entrance to the runway.

6. Construction machinery, excavators, dumpers, rollers can be borrowed on the basis of purchased tokens at the box office. These machines can be driven by a visitor from 8 years of age or a younger child accompanied by an adult. The trained staff will explain to each visitor the operation of the individual machine. The visitor will not strike the tires or other machines with unreasonable construction machines . He adapts his ride to his abilities. Rules and driving conditions will be posted at the entrance to the track with construction machinery.

OPENING HOURS AND SEASON

ANIMALS

1. With the exception of guides who are trained by a certified trainer who provides the relevant training and certification document, no pets or domestic animals are allowed in any area of BAGRPARK, including the car park.

RESPONSIBILITY

1. BAGRPARK, sro does not accept any responsibility for any personal injury suffered by the visitor or for damage to the visitor's property, if it was caused by the visitor's own negligence as a result of, but not limited to, non-compliance with "Health and Safety Conditions for Visitors", as stated above, or non-compliance with safety signs and warnings or instructions from the park operator.

2. Any visitor who intentionally or negligently injures any BAGRPARK staff or damages any BAGRPARK property or who causes damage or injury to other visitors and their property shall be fully responsible for his actions and costs and the resulting losses.

3. The entry and visit of a guilty visitor to BAGRPARK will be irrefutable proof of his / her consent to accept full responsibility in the circumstances set out and defined in the previous two paragraphs.

4. All property, including vehicles belonging to visitors and any other visitors to BAGRPARK, is the sole responsibility of the owner (s) and BAGRPARK accepts no responsibility for any damage to its property loss or theft.

5. BAGRPARK does not exclude liability for death or personal injury resulting from their own negligence or fraudulent misrepresentation or for any other claim that cannot be limited or excluded by law.

6. VSTUP

1. Entry to BAGRPARK is only for a ticket that can be purchased either online in advance or on the day at the box office of BAGRPARK Online purchases and advance payments usually include a discount

2. For health and safety reasons, most attractions are subject to minimum or maximum height restrictions. See paragraph 9 above for more details.

3. The ticket holder may enjoy unlimited entry to the non-motorized attractions available in the park, unlimited access / use of playgrounds, trampolines, a dredger, climbing frames and a children's transport playground.

4. For motor attractions, the visitor can buy tokens worth 50 CZK / pc.

5. Tickets / reservations are not for a fixed date, but must be used in a given season.

6. No amount will be refunded for unused tickets. In mitigating circumstances and for a fee, BAGRPARK, sro may transfer unused tickets. This would have to be before the date of the visit and in writing to ticketing@bagrpark.cz

EXPERIENCE DAYS AND EVENTS - PRIVATE AND CORPORATE RESERVATIONS

1. All visitors who participate in one or more private and corporate events BAGRPARK must be at least fifteen (15) years old, if the visitor is not 15 years old, they must have an escort who is responsible for it.

PERSONAL INFORMATION OF THE VISITOR

1. Personal data of the visitor collected during the process of booking and purchasing tickets will be securely stored and retained in full compliance with the principles of personal data protection of BAGRPARK, s.ro., as set out below, and the Data Protection Act.

2. Such personal data that BAGRPARK may collect may be shared with its business partners, but not with any of its affiliates or suppliers, or with any other third party.

3. Such securely stored personal data of the visitor may be used for the purpose of contacting visitors with such details as, but not necessarily, BAGRPARK, sro or its corporate partners: information bulletins and bulletins; special offers or other promotions that may be of interest.

4. Subject to paragraphs: 1-2 above and in accordance with them and subject to paragraphs 6 and 7: below, visitors shall be deemed to have automatically given their consent or permission to use their personal data for the above purposes. , but may at any time revoke any such implied consent or authorization, as detailed in paragraphs 6 and 7.

4. All information that may be collected and held by BAGRPARK, sro will be stored in full compliance with the GDPR Act of the Czech Republic, and where appropriate. All data protection legislation adopted by the Czech government, as well as data protection laws throughout the EU and individual EU member states.

5. In addition to contacting visitors in connection with the provision of the services they have requested, BAGRPARK or its corporate partners may correspond with visitors either by letter, e-mail or other means in order to pass on such items. as, but not necessarily, BAGRPARK or its corporate partners: newsletters and bulletins; special offers or other events that might interest you. GENERAL

1. Visitors may not rely on any statement, promise or commitment made to BAGRPARK that is not set out in these terms and conditions, unless this has been confirmed in writing by either the manager or executive of BAGRPARK, sro

2. No change to these conditions will be valid unless such change has been defined and confirmed in writing by either the manager or the managing director of BAGRPARK.

3. The operating log can be updated continuously and can be viewed at the cash register or in the office of the BAGRPARK management.

NOTIFICATION

1. All notices which must be submitted in accordance with these Conditions shall be in writing and may be delivered in person, by post or by e-mail to the registered office of the company. To whom should the notice be delivered, or to any other address which the party has notified to the other party in writing or by e-mail. Any such notice shall be deemed to have been received: in person, upon delivery; by registered mail, 48 hours after dispatch; or, in the case of an e-mail, when that e-mail is sent.

PROVISION

1. If any competent authority determines that any provision or part (s) of these Terms and Conditions is unenforceable to any extent, that provision or part thereof to that extent shall be excluded from the remaining provisions, which shall continue to apply to the full extent permitted by applicable law.

THIRD PARTY RIGHTS

1. Nothing in this Agreement is intended for the benefit or enforceability of third parties and the application of contract law (third party rights)
